1. SCOPE OF APPLICATION
These general terms and conditions (hereinafter referred to as the ” General Terms and Conditions of Access to FIRA USA ” or ” FIRA USA Access GTCs “) are applicable to any visitor (hereinafter referred to as the ” Visitor ” ), participating in any form whatsoever in the International Forum of Agricultural Robotics USA (hereinafter referred to as ” FIRA USA “), organized annually by the Global Organization For Agricultural Robotics, Association under the French Law of 1901 and domiciled at 235 rue de la Montagne Noire, 31750 Escalquens (hereinafter referred to as ” GOFAR ” or “the Organizer “).
The Visitor is a professional in the agricultural sector, in robotics or new technologies, who acts exclusively for the needs of his/her professional activity, which the Visitor acknowledges and accepts. FIRA USA is not accessible to non-professional individuals (consumers). The dates, places, content and terms of access to FIRA USA are specified on the website:https://www.fira-usa.com/ .
FIRA USA is arranged by the Organizer in an on-site format:
– An On-site format which takes place on the dates and places determined by the Organizer (hereinafter referred to as ” ON-SITE EVENT “).
These FIRA USA GTCs govern the essential and determining conditions for any participation in FIRA USA, regardless of the ON-SITE EVENT.
By registering for FIRA USA, the Visitor declares to have read and accepted the present General Terms and Conditions.
2. REGISTRATION PROCEDURES
FIRA USA is only accessible to visitors after nominative registration is duly completed and paid for online on the website https://www.fira-usa.com/
Any group registration must be requested and paid directly to the Organizer at contact@fira-agtech.com. In this case, upon receipt of full payment for the group’s registration, the Organizer will send a dedicated promotional code to allow the personal registration of each person in the group before the beginning of the event.
At the time of registration, the Visitor is required to verify the accuracy of all information provided. The Visitor’s registration includes the different services provided in the ticket and option paid.
3. PRICES
The price of registration depends on when the registration is completed. The price list for nominative registrations is in the FIRA USA website https://www.fira-usa.com/
All prices indicated by the Organizer or on the FIRA USA website are expressed in dollars. All registrations must be paid in full, if applicable with the late registration supplement, no later than the day the event begins in order for the registration to be validated. The Visitor will also be able to purchase an entry ticket for the duration of the event at the current price. All expenses incurred by the Visitor in connection with his/her attendance to the FIRA USA ON-SITE EVENT, in particular transport and accommodation, are at the Visitor’s expense and under his/her sole responsibility. These expenses shall not give rise to any payment or reimbursement by the Organizer.
4. TERMS OF PAYMENT
Any registration will be invoiced by the Organizer and must be paid upon receipt, unless a different payment term has been agreed upon with the Organizer and mentioned on the invoice.
● Nominative registrations must be paid at the time of registration by credit card on the FIRA USA website.
● Group registrations must be paid by bank transfer indicating to the Organizer in the transfer reference “GROUP NAME + FIRA USA + YEAR”,
Any payment by wire transfer may be subject to charges by the local bank from which the payment is issued.
Payment by check will not be accepted, except on-site during the event.
No discount is granted for early payments.
Upon receipt of payment, the Organizer will send a confirmation of registration. No registration will be validated and no access to FIRA USA will be allowed unless the registration price is paid in full.
5. LATE OR NON-PAYMENT
Any sum due and not paid by the due date indicated on the invoice will automatically result in the application of:
– Penalties of 5% of the total unpaid amount, which will begin to run the day after the due date indicated on the invoice.
– A lump-sum compensation of $ 40 for collection charges per unpaid invoice on its due date, which may be increased up to the costs actually incurred by the Organizer to recover the debt if they are higher (art L441-10 of the French Commercial Code).
In addition, if the Visitor fails to pay the full price on the opening day of FIRA USA, the Organizer may suspend the Visitor’s access in all or part of the event without prior formality until the price has been paid in full.
6. CANCELLATION – MODIFICATION
6.1. Cancellation – modification requested by the Visitor:
Any registration validated by the Organizer, after receipt of full payment, is final. If the visitor cancels at least 30 days before the event date he/she will be charged a 15% cancellation fee. We regret that no cancellations can be accepted after this date and full payment is due. Substitutions are welcome at any time.
No refund will be granted if the information provided by the Visitor at the time of registration is inaccurate.
Any modification requested by the Visitor whose registration is validated less than fifteen (15) days before the beginning of the event will give rise to a handling fee of 40 dollars. Any modification or cancellation by the Visitor must be notified to the Organizer in writing.
6.2. Cancellation – modification of the conditions of the FIRA USA ON-SITE EVENT format by the Organizer:
Regarding the on-site version of the event, the Organizer reserves the right at any time to modify the opening date or the duration of FIRA USA, its location within less than five hundred (500) kilometers / 310 miles from the initial venue, the general layout, the opening and closing times, the admission fees, if an event external to the Organizer required such adaptations in the interest of the proper running of FIRA USA, the good visibility of the partners and in the interest of the Visitors.
In the case of a change in the dates and/or the venue hosting FIRA USA, this change will be notified to the Visitor in writing.
The Visitor will have fifteen (15) days from the notification received to request in writing to the Organizer the cancellation of his/her registration for the ON-SITE EVENT edition. In the absence of a request to cancel the ON-SITE EVENT of the registration made in writing within the aforementioned period, the Visitor is deemed to have accepted the modification notified by the Organizer.
The Visitor shall under no circumstances obtain reimbursement of any expenses that he/she may have incurred personally such as transportation and accommodation costs.
6.3. Cancellation by the Organizer:
The provisions of this paragraph are applicable only if and when the entire FIRA USA, , was to be canceled outright, without any postponement or alternative being put in place by the Organizer.
In this case, unless the parties agree otherwise to allocate the visitor’s participation in a future edition of FIRA USA, the Visitor will then be reimbursed the amount of his/her registration, after deduction of the handling fee corresponding to 15% of the registration price. The Visitor shall under no circumstances obtain reimbursement of any expenses that he/she may have incurred personally such as transportation and accommodation costs.
In any event, the Organizer shall not be held responsible for the non-performance of the Organizer’s obligations in the case of force majeure under the conditions set forth in the article ” FORCE MAJEURE ” hereafter.
7. LIABILITY – INSURANCE
The Organizer is insured against the direct consequences of its activity in its capacity as organizer of FIRA USA.
This Organizer’s liability shall not under any circumstances be extended to damage caused by third parties to Visitors, exhibitors and partners.
The Organizer is not liable for any damage caused to the Visitor’s property, or property placed in its care which would not be the direct consequence of a breach or fault of the Organizer. For the ON-SITE EVENT version, the Organizer is not liable for any damage that the Visitor could cause to third parties, including the manager and the owner of the site hosting FIRA USA.
8. FORCE MAJEURE
The Organizer shall not be held liable for any failure to perform its obligations if the Organizer is prevented from performing its obligation by any event of force majeure. Force majeure occurs when an event beyond the control of the Organizer, which could not be reasonably foreseen at the time the contract was concluded, and the effects of which could not be avoided by appropriate measures, prevents the performance of its obligation by the debtor.
The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of the French courts and tribunals: pandemic, lockdown or curfew measures preventing the event from taking place, administrative closure of the site where the FIRA USA was to take place, earthquakes, storms, fires, floods, lightning or even the shutdown of telecommunication networks, riots, transport strikes, national strike preventing people from traveling to participate in the event, and preventing the event from taking place as scheduled.
If the impediment is temporary, performance of the obligation shall be suspended until the impediment has disappeared:
● If the impediment has not resulted in the postponement of FIRA USA, then the Visitor shall remain bound by the commitments incumbent on him/her under the conditions of these GTCs.
● If the impediment has led to the postponement of FIRA USA, the Organizer will inform the Partner in writing of the conditions for postponing the event.
The Visitor will have the option of either accepting these conditions and continuing to participate under the conditions initially provided for as modified, or canceling his/her participation without indemnity or compensation.
The Visitor must notify the Organizer of his/her choice in writing within fifteen (15) days of receiving information on the new conditions of FIRA USA sent by the Organizer. In the absence of a written response to the Organizer within the aforementioned fifteen (15) day period, the Visitor will be deemed to have accepted the conditions for postponement of the event, and will be bound towards the Organizer.
If the impediment is permanent, the Organizer may cancel the event until the last day. The Visitor’s registration will then be terminated and the parties are released from their obligations for the future. The Organizer will notify the Partner in writing as soon as possible and no compensation or indemnity will be due from either party. The Visitor may request a refund of his/her registration, except for an administrative fee of 15% of the total amount of the registration which remains acquired by the Organizer.
9. SPECIFIC PROVISIONS FOR ACCESS TO THE FIRA USA ON-SITE EVENT
Access to the FIRA USA venue is only authorized to persons who are validly registered. No person shall be admitted to the event without presenting a ticket issued or approved by the Organizer. Access to the FIRA USA site is personal, non-exchangeable. Substitutions are welcome at any time after approval by the Organizers.
The Organizer reserves the right to prohibit entry or to have expelled any person whose presence or behavior would be detrimental to the security, tranquility or image of the event, the Organizer, any FIRA USA partner, exhibitor, speaker or other visitor.
10. PHOTOGRAPHY / IMAGE RIGHT
The Visitor expressly authorizes the Organizer, free of charge:
• to produce, if the Organizer so wishes, photos and/or videos on which the visitor could appear during the visit of his/her booth at FIRA USA;
• to freely use these images on all media, and in particular promotional media (including the Internet), in France and abroad, and without any time limit as from the signing of the present request to participate;
• and this within the framework of the promotion of agricultural robotics.
The Visitor who does not wish to appear on the videos and/or photographs and/or the internet media used to promote FIRA USA must give prior written notice to the Organizer before the opening of FIRA USA.
Furthermore, any Visitor who wishes to take pictures of FIRA USA must inform the Organizer in writing beforehand. In this respect, the Visitor shall personally obtain the necessary authorizations to take pictures during FIRA USA and shall be solely responsible for complying with the image rights of each person who may appear in the pictures.
11. PERSONAL DATA
The Organizer, as the data controller, processes the Visitor’s personal data in the context of managing his/her request for partnership and participation in FIRA USA, and in the context of his/her business relations with the Organizer. This information and the Visitor’s personal data are also processed for security purposes in order to comply with the Organizer’s legal and regulatory obligations, and to enable the Organizer to improve and personalize its services.
Depending on the Visitor’s choices, the Visitor may also receive news about the Organizer’s activity and services related to FIRA USA, through any channel.
Where applicable, the Visitor’s data may be processed, on the basis of consent that he/she can withdraw at any time, to send him/her business proposals and news through all the channels, regarding other promotional activities of GOFAR, and also to be communicated to FIRA USA partners with whom the Visitor has had contact within the framework of FIRA USA in order to continue their exchanges.
Only the Organizer’s internal teams and the authorized service providers involved in the organization and management of FIRA USA have access to the Visitor’s personal data.
In accordance with the applicable regulations, the Visitor has a right of access, a right of rectification, a right to object to the processing of his/her data, a right to erasure and limitation of processing and a right to the portability of his/her data, which he/she may exercise, at any time, by electronic or postal means, at the following address: association GOFAR 235 rue de la Montagne noire – 31720 Escalquens – France or gwendoline@fira-agtech.com.
Finally, the Visitor has the right to lodge a complaint with the French data protection agency that is the “Commission Nationale de l’Informatique et des Libertés” (CNIL).
The Visitor’s personal data is kept for the duration of his/her business relationship with the Organizer under the conditions specified by the FIRA USA Personal Data Retention Policy. Within the framework of the FIRA USA website, the Platform has implemented technical and organizational measures to ensure the protection and confidentiality of its users’ personal data. The conditions of confidentiality and protection of personal data by the platform are detailed in its personal data confidentiality policy accessible on its website, the link of which is communicated to the Visitor on the information documents relating to the event.
DATA PERMISSIONS
When you register, an account will be created with all the information that you entered. This account will allow you to access the virtual platform to network with other attendees before, during and after the event. Your data will be shared with GOFAR and its digital platform, SWAPCARDS, provider in order to deliver this service.
Your data will be protected, and not commercialized. You have the right to access your data, and to edit or delete it at any time.

* Your name, job title and company name will automatically appear in the searchable list of participants on the virtual summit platform, for the purpose of networking. You may choose to turn this off within the platform, which will hide your profile completely. You will manage your own profile to include additional information such as LinkedIn and Twitter contacts, and specific areas of interest. Your telephone and email contact details will not be visible to other users. When you engage directly with other summit participants through 1-1 messages, scheduled meetings or exchanged contacts, your contact data will be shared with them. Delegates are able to download a record of their own summit activity, including the details of people they have connected with for follow up after the event. Email/phone data will not be shared with anyone you have not actively connected with.
